Terms of Service

These terms govern what you may do with acsMacL. They do not govern the purchase — that is Paddle's, see section 1.

The German version of these terms is the binding one. This translation is provided for convenience.

1. Who provides these terms, and what they cover

These terms govern the use of acsMacL. The provider is acs - it-systems UG (haftungsbeschränkt), Lindenhöhe 32, 94127 Neuburg a. Inn, Germany.

They do not cover the purchase. Payments are handled by Paddle.com Market Limited, 30 Old Bailey, London EC4M 7AU, United Kingdom. Paddle acts as the seller (merchant of record); the purchase contract is between you and Paddle. It is governed by Paddle's buyer terms and Paddle's refund policy. Payment, invoicing, VAT and cancellation are governed by those alone.

2. The free version

acsMacL runs without payment and without an account. The free version is not a trial: it has no end date and no time limit. Which features it includes is listed on the product page; we may change the scope for future versions, but not for a version you have already installed.

3. The PRO version and your licence key

A licence key unlocks the PRO features. You receive a non-exclusive, non-transferable, perpetual right to use acsMacL in unmodified form with those features.

4. What is not permitted

You may not resell, rent out, sublicense or bundle acsMacL into another product, and you may not pass the software or its documentation on to third parties. You may not circumvent, alter or disable the licence check, and you may not generate or distribute keys.

You may make backup copies — as many as your backup routine needs.

Your statutory rights are unaffected, in particular the right to decompile the program as far as §§ 69d and 69e of the German Copyright Act permit. These terms do not restrict that.

5. Updates

Updates within the same major version are free. This does not create a claim to any particular future feature. Whether a new major version appears, when, and at what price is our decision.

Update checks are started by you; in the settings you can switch them to “on launch”. acsMacL installs nothing on its own.

6. Defects and liability

For the free version we are liable only for intent and gross negligence.

For the PRO version your contractual partner is Paddle, so your rights regarding defects are against Paddle. Where liability towards us arises, we are liable without limitation for intent and gross negligence, for injury to life, body or health, for warranted characteristics, under the German Product Liability Act, and in all cases where the law does not permit a limitation. For ordinary negligence we are liable only for breach of a material obligation and only up to the foreseeable damage typical for this kind of contract.

What the warranty is measured against: that acsMacL is generally fit for the purposes described on the product page. We cannot warrant a version modified by you or by third parties. Malfunctions caused by the stated system requirements not being met are not defects — acsMacL requires macOS 14 or newer and Apple silicon; it is untested on Intel Macs and is not offered for them.

A note we mean seriously: acsMacL can move and copy files and put them in the Trash. It shows you what it is about to do first. Keep backups of your data anyway — with any program that works on files.

7. Your data

What acsMacL processes, and what this website does, is described in our privacy notice. In short: your search terms, file names, paths and file contents do not leave your machine.

8. Licences given away free of charge

Keys we hand out without payment — for example in the test programme — are full PRO licences: they do not expire and cover two Macs, like purchased ones. There is no entitlement to such a key, and giving us feedback creates no obligation for you. There is no purchase contract for these licences and therefore no right of cancellation — there is nothing to cancel.

9. Changes to these terms

We may change these terms for future versions and future purchases. For a licence you already hold, the version that applied at the time of acquisition remains in force.

10. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory provisions of the country of your habitual residence remain unaffected.

11. Final provisions

Should any of these provisions be or become invalid, the remainder stay in force.
